Hawxhurst LLP attorneys have a wealth of knowledge and experience in a range of employment-related matters, including discrimination, wrongful termination, unpaid or withheld compensation, wage-and-hour litigation, and non-compete and trade secret disputes.  Clients look to us for aggressive defense of individual or proposed class claims in courts and arbitrations across the United States.  We are often retained by clients to resolve executive compensation disputes and have also represented clients as plaintiffs against employees who misappropriate trade secrets.

Some of our representative employment matters include:

  • Successfully representing a Fortune 500 company in numerous defense matters against employees bringing claims in state and federal court, arbitration, and administrative hearings for discrimination and unpaid compensation. These matters have included claims for alleged unpaid wages, unpaid performance bonuses, and unpaid commission, among other claims.
  • Defeating claims brought by a former employee of the Firm’s client alleging that he was owed nearly one million dollars in commission compensation, and that a company the client had acquired (and six of its former executives) had conspired to defraud him. The Firm obtained dismissal of the plaintiff’s racketeering claim brought in federal court, and then obtained summary judgment against the remainder of the plaintiff’s claims in arbitration.
  • Obtaining a settlement for an investment banker against her former employer for breach of an oral agreement to pay a large performance bonus.  Immediately after being engaged, the Firm hired an executive compensation and tax expert to help formulate arguments to defeat the employer’s anticipated defense that the bonus, even if promised, could not have been paid under federal securities and tax laws.  We successfully presented our client’s case at mediation, which resulted in settlement without a suit ever having been filed.
